Agreement to Terms
By downloading, installing, or using the Gympal application (hereby referred to as "Application"), you agree to be bound by these Terms of Service. These terms are a legal agreement between you and Audun Hilden (hereby referred to as "Service Provider"). If you do not agree to these terms, do not use the Application.
Use of the Application
The Application is provided for personal, non-commercial use only. You agree to use the Application only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations.
You agree not to:
- Use the Application in any way that could damage, disable, overburden, or impair the Application or interfere with any other party's use of the Application
- Attempt to gain unauthorized access to any part of the Application or any systems or networks connected to the Application
- Use any automated means, including bots, scrapers, or crawlers, to access or interact with the Application
- Reverse engineer, decompile, or disassemble any part of the Application
- Use the Application to transmit any harmful, offensive, or unlawful content
User Accounts
To access certain features of the Application, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information when creating your account and to update that information to keep it accurate. The Service Provider reserves the right to suspend or terminate your account if any information provided is inaccurate, false, or no longer current.
User-Generated Content
The Application may allow you to submit, upload, or share content such as workout logs, progress data, and other information (collectively, "User Content"). You retain ownership of your User Content, but by submitting it you grant the Service Provider a non-exclusive, worldwide, royalty-free license to use, store, and display that content solely for the purpose of operating and improving the Application.
You are solely responsible for your User Content and represent that you have all rights necessary to grant the above license.
Health & Fitness Disclaimer
The Application provides fitness tracking and informational content for general wellness purposes only. The content provided is not intended to be a substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of your physician or other qualified health provider before beginning any new exercise program. The Service Provider is not liable for any injury or harm that may result from your use of the Application or reliance on any content within it.
Intellectual Property
All content, features, and functionality of the Application — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of the Service Provider and are protected by applicable copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works of any part of the Application without prior written permission from the Service Provider.
Freemium & Subscriptions
Gympal is offered as a Freemium service. Certain features may require a paid subscription. Subscription fees, billing cycles, and cancellation terms will be disclosed at the time of purchase. All payments are processed through the applicable app store platform (e.g. Apple App Store or Google Play), and refunds are subject to that platform's policies.
Limitation of Liability
To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Application, even if the Service Provider has been advised of the possibility of such damages.
Termination
The Service Provider may terminate or suspend your access to the Application at any time, with or without cause or notice. Upon termination, your right to use the Application will immediately cease. All provisions of these Terms that by their nature should survive termination shall do so, including ownership provisions, warranty disclaimers, and limitations of liability.
Changes
The Service Provider reserves the right to modify these Terms of Service at any time. When changes are made, the revised date at the top of this page will be updated. Your continued use of the Application after any changes constitutes your acceptance of the new terms. You are encouraged to review these Terms periodically.
Governing Law
These Terms of Service are governed by and construed in accordance with applicable law. Any disputes arising under these terms shall be resolved in the appropriate courts of competent jurisdiction.
